PUBLIC NOTICE

The Department of Health, State of Hawaii (DOH), is notifying all interested persons of the proposed settlement between the DOH and Edwin DeLuz Trucking and Gravel, LLC (Edwin DeLuz). The DOH issued a Notice and Finding of Violation and Order (NOVO) in Docket No. 12-CA-EO-29, alleging that Edwin DeLuz violated state air pollution laws, Hawaii Revised Statues §342B-11, Hawaii Administrative Rules
§11-60.1-2, Covered Source Permit No. 0454-01-C, Noncovered Source Permit (NSP) No. 0360-01-N,
NSP No. 0383-01-N, NSP No. 0474-01-N, and
NSP No. 0511-01-N by failing to meet various monitoring, reporting, and annual fee requirements.

A Consent Order (CO) has been drafted that proposes to settle this case. The proposed CO and NOVO is available for public review during regular office hours, Monday through Friday, 7:45 a.m. to 4:15 p.m., at the following locations:
