PUBLIC NOTICE

The Department of Health, State of Hawaii (DOH), is notifying all interested persons of the proposed settlement between the DOH and Island Commodities. The DOH issued a Notice and Finding of Violation and Order (NOVO) in Docket No. 12-CA-EO-21, alleging that Island Commodities violated state air pollution laws, Hawaii Revised Statues §342B-11, Hawaii Administrative Rules §11-60.1-2, and Noncovered Source Permit No. 0377-01-N by failing to:

1) Submit to the DOH the semi-annual monitoring report for the reporting period of July to December 2011, within sixty (60) days after the end of the semi-annual calendar period; and
2) Submit to the DOH the annual emissions report for the reporting period of January to December 2011 within sixty (60) days after the end of the calendar year.

A Consent Order (CO) has been drafted that proposes to settle this case. The proposed CO and NOVO is available for public review during regular office hours, Monday through Friday, 7:45 a.m. to 4:15 p.m., at the following location:
