PUBLIC NOTICE

The Department of Health, State of Hawaii (DOH), is notifying all interested persons of the proposed settlement between the DOH and Elite Energy Systems, LLC. The DOH issued a Notice and Finding of Violation and Order (NOVO) in Docket No. 13-CA-EO-06, alleging that Elite Energy Systems, LLC, violated state air pollution laws, Hawaii Revised Statues §342B-11, Hawaii Administrative Rules §11-60.1-2, Noncovered Source Permit (NSP) No. 0639-01-N, and NSP No. 0701-01-N by failing to meet various monitoring, reporting, and annual fee requirements.

A Consent Order (CO) has been drafted that proposes to settle this case. The proposed CO and NOVO is available for public review during regular office hours, Monday through Friday, 7:45 a.m. to 4:15 p.m., at the following locations:

Oahu:
