PUBLIC NOTICE OF EMERGENCY RULES

Pursuant to section 91-4, Hawaii Revised Statutes (HRS), notice is hereby given that the Department of Health, Developmental Disabilities Division has enacted emergency rules that temporarily continue, subject to the availability of state funding, state services for citizens of Compact of Free Association (COFA) nations and legal permanent residents admitted to the United States for less than five years who are age nineteen years and older and lawfully present in the state, who would be eligible for services for persons with developmental or intellectual disabilities but for citizenship status. These rules do not apply to legally present pregnant women and children under the age of nineteen, because they are still eligible for Medicaid.

These emergency rules are necessary to ensure that individuals with developmental disabilities or intellectual disabilities who are eligible for services under this chapter may receive or continue to receive necessary and appropriate services. These rules are necessary to ensure the safety of this population and have been promulgated in accordance with section 91-3(b), HRS. The emergency rules became effective upon filing with the Lieutenant Governor’s office on November 19, 2014 and have been adopted for a period not longer than 120 calendar days.

A copy of the emergency rules will be available for public viewing from Monday through Friday, excluding holidays, between the hours of 9:00 a.m. until 2:00 p.m at the following locations:
