NOTICE OF PUBLICATION AND NOTICE OF PUBLIC HEARING

Notice is hereby given that the Council of the County of Kaua’i will hold a public hearing on Wednesday, December 10, 2014, at 8:30 a.m., or soon thereafter, at the Council Chambers, 4396 Rice Street, Suite 201, Historic County Building, Lihu’e, on the following:

A BILL FOR AN ORDINANCE AMENDING SUBSECTIONS 8-15.1(B) AND
8 15.1(D), KAUA’I COUNTY CODE 1987, AS AMENDED, RELATING TO ADDITIONAL DWELLING UNIT ON OTHER THAN RESIDENTIALLY ZONED LOTS

This Bill proposes to amend Subsections 8-15.1(b) and 8-15.1(d), Chapter 8, Kaua’i County Code 1987, as amended, relating to Additional Dwelling Units (ADU) on other than Residentially Zoned lots, by extending the current sunset date of December 15, 2014, for an additional ten (10) years to December 15, 2024.

This Bill also establishes an annual re-certification process to be completed on or before February 15 of the applicable year for those applicants who have met the requirements in Sec. 8-15.1(d)(6). The Planning Department will administer this process beginning in 2015, and charge an initial regulatory fee of Five Hundred Dollars ($500.00) for the initial registration. No additional fee will be charged for each subsequent year of registration. Annual re-certification shall cease to be required upon publication of the “Notice of Completion” by the applicant. This bill also establishes procedures should the applicant fail to obtain an annual re-certification.

This Bill also establishes an “ADU Re-certification Fund” for the regulatory fee collected. These funds are deemed appropriated upon receipt, and may be expended by the Department of Planning in accordance with the County’s Budget Ordinance for the hiring of persons employed on a fee, contract, or piecework basis, or independent contractors to assist in conducting inspections. Any moneys remaining in the ADU Re-certification Fund on December 15, 2024 shall be transferred and deposited into the General Fund.

All interested persons who wish to present their comments may do so at the public hearing. Written testimony prior to the hearing would be appreciated. Copies of the proposed Bill are available at the Office of the County Clerk, Council Services Division.

(The Council Committee or Council may amend this Bill at its subsequent meetings. Meeting notices are posted at least 6 days in advance at the County Clerk’s Office and the public may also testify at any of these meetings.)
