PUBLIC NOTICE

Emergency Permit for Treatment and Storage
of Waste Fireworks to
Grucci, Inc. Operator and Robert Hoohuli, Landowner

87-879 Paakea Rd, Waianae, Hawaii 96792 (Approximately 5400 pyrotechnic devices)

The State of Hawaii, Department of Heath, Solid and Hazardous Waste Branch, 919 Ala Moana Boulevard, Room 212, Honolulu, Hawaii, 96814, intends to issue within 45 days a State Hazardous Waste Emergency Permit (EPA ID#HIP 000 142 521 ) in conformance with the Hawaii Revised Statues chapter 342J to the Operator and Landowner.

This permit is issued under the authority of the Hawaii Administrative Rules, Chapter 11-270-61. The rules allow issuance of temporary emergency permits for non-permitted activities in the event the Director of Health finds imminent and substantial endangerment to human health and the environment.

This permit allows Grucci to mitigate a threat to human health and the environment caused by waste fireworks. The waste fireworks are currently stored at the Waikele Storage Facility under the custody of the Federal Department of Treasury. The waste fireworks need to be disposed of due to shelf life, and are deemed unsafe for long-term storage.

The permit allows Grucci to treat and store the waste fireworks. The waste fireworks will be transported locally and burned at a designated site at 87-879 Paakea Rd, Waianae. This permit allows the ignition (electrical or fire) of the waste fireworks. Safety precautions will be in place to prevent harm to the public and surrounding area and personnel involved. The Honolulu Police and Fire Departments have been apprised of this situation and comments have been included in the permit.

The permit shall be effective for ninety (90) calendar days from the issuance of the permit. Grucci, Inc. anticipates needing additional time beyond the initial 90 day limit to complete their work. The Department of Health intends to issue at least one additional temporary permit with conditions substantially similar to those in the initial 90 day permit should it become necessary to do so.
