NOTICE OF DISPOSITION
OF IMPOUNDED VESSEL
BY PUBLIC AUCTION

Notice is hereby given that a 38’ fiberglass sailing vessel named “NEW LIEF”, Hawaii Registration no. HA 8818 H, has been impounded by the DEPARTMENT OF LAND AND NATURAL RESOURCES, DIVISON OF BOATING AND OCEAN RECREATION, 333 Queen Street #300, Honolulu, Hawaii 96813. Scheduled time of disposition by public auction will be at 9:00 a.m. on May 30, 2014 at the Ke’ehi Boat Club located at the Ke’ehi Small Boat Harbor, 4 Sand Island Access Road, Honolulu, Hawaii 96819. This vessel will be disposed of by public auction pursuant to Chapter 200, Hawaii Revised Statutes.

An auction catalog, with pertinent information and auction procedure instructions may be obtained in person during the hours of 7:45 a.m. to 4:00 p.m., Monday through Friday, at the Department of Land and Natural Resources, Division of Boating and Ocean Recreation, Oahu District Office, 4 Sand Island Access Road, Honolulu, Hawaii 96819. Auction catalogs and auction procedures may also be obtained at the Ala Wai Small Boat Harbor, Haleiwa Small Boat Harbor, Heeia Kea Small Boat Harbor, Ke’ehi Small Boat Harbor and the Waianae Small Boat Harbor.

Interested buyers may inspect the impounded vessel prior to the auction. Interested buyers should contact a harbor agent at the Ala Wai Small Boat Harbor at 973-9727.

A copy of the auction catalog and auction procedures shall be available for inspection at the Hawaii District Boating Office at Honokohau Small Boat Harbor, Kailua-Kona, Hawaii; Maui District Boating Office, Wailuku, Maui; and the Kauai District Boating Office, Lihue, Hawaii.

The listed item contained in the auction catalog is sold as is, where is. There are no guarantees or warranties. The sale of this vessel does not include a berth, mooring, storage area or trailer. Buyers must make separate arrangements for a berth. Interested parties are informed of the requirement, under “provision” for the purchaser to remove the vessel from its present location within the prescribed time after the issuance of the Bill of Sale. The prescribed time for removal after the auction shall be included in the auction catalog. No vessel shall be sold for less than its minimum bid upset price as noted in the auction catalog.

The Department of Land and Natural Resources reserves the right to remove any item from the auction. The stated item is under the custody of the Department of Land and Natural Resources. Trespassing is prohibited.

If the vessel is not sold at auction, the vessel will be disposed of in accordance with Hawaii Revised Statutes Section 200-16.
