ON DRAFT AIR PERMIT
REGULATING THE EMISSIONS OF AIR POLLUTANTS

Pursuant to Hawaii Revised Statutes (HRS), Chapter 342B-13 and Hawaii Administrative Rules (HAR), Chapter 11-60.1, the Department of Health, State of Hawaii (DOH), is requesting public comments on the following DRAFT PERMIT AMENDMENT presently under review for:

Bioenergy Facility
Located at: 28-283 Sugar Mill Road, Pepeekeo, Hawaii
The DRAFT PERMIT AMENDMENT is described as follows:
In accordance with Hawaii Administrative Rules, Chapter 11-60.1 and 40 CFR §70.7(g)(4), and pursuant to EPA’s Order Granting in Part and Denying in Part Petition for Objection to Permit for Petition No. IX-2011-1, the Department of Health is proposing to amend Covered Source Permit (CSP) No. 0724-01-C issued to Hu Honua Bioenergy on August 31, 2011. The amendment incorporates additional requirements to include the boiler’s emissions during periods of malfunction or upset conditions and the emergency biodiesel engine generator’s emissions when calculating the total emissions of CO, NOx, and HAPs. It also includes the methodology for calculating the total emissions of CO, NOx, and HAPs for recordkeeping and reporting purposes. Accordingly, the applicable annual emissions and monitoring report forms are also revised.
Covered Source Permit (CSP) No. 0724-01-C approved the construction and operation of a bioenergy facility which included a 407 MMBtu/hr boiler. The boiler is subject to federal requirements of 40 CFR Part 60, Subpart Db – Standards of Performance for Industrial-Commercial-Institutional Steam Generating Units and 40 CFR Part 63, Subpart JJJJJJ – National Emission Standards for Hazardous Air Pollutants for Area Sources: Industrial, Commercial and Institutional Boilers, and incorporated an ESP and baghouse to control particulate matter (PM), urea injection to control nitrogen oxides (NOx), and a dry sorbent injection system to control hydrogen chloride (HCl) and sulfur oxides (SOx). The boiler was allowed only to burn wood and biodiesel.
The ADMINISTRATIVE RECORD, consisting of the DRAFT PERMIT AMENDMENT, the addendum to the permit review summary, and non-confidential supporting materials from the applicant, is available for public inspection during regular office hours, Monday through Friday, 7:45 a.m. to 4:15 p.m., at the following locations:

All comments on the draft permit amendment and any request for a public hearing must be in writing, addressed to the Clean Air Branch at the above address and must be postmarked or received by April 14, 2014.
Any person may request a public hearing by submitting a written request that explains the party’s interest and the reasons why a hearing is warranted. DOH may hold a public hearing if a hearing would aid in DOH’s decision. If a public hearing is warranted, a public notice for the hearing will be published at least thirty days in advance of the hearing.

DOH will only be accepting comments on the draft permit amendment conditions and the addendum to the permit review summary.
DOH will make a final decision on the permit amendment after considering all comments and will send notice of the final decision to each person who has submitted comments or requested such notice.
