NOTICE OF PUBLIC HEARING
Pursuant to sections 91-3, 92-41, and 333F-18, Hawaii Revised Statutes (HRS), notice is hereby given that the Department of Health will hold a public hearing to receive testimony or amend the proposed Hawaii Administrative Rules (HAR) concerning the repeal of Hawaii Administrative Rules (HAR), Chapters 11-86, “Earnings and Income of Patients and Wards of Waimano Training School and Hospital,” 11-87, “Payment Fees for Waimano Training School and Hospital,” and 11-88 “Services for the Developmentally Disabled or Mentally Retarded;” and adoption of Chapter 11-88.1, “Services for Persons with Developmental or Intellectual Disabilities.”
The proposed rules repeal HAR chapters pertaining to Waimano Training School and Hospital (WTSH) because WTSH officially closed in 1999; and adopt Chapter 11-88.1, HAR, which reflect updates in the Developmental Disabilities Division’s functions that relate to services for individuals with developmental or intellectual disabilities. Such functions include: determining eligibility for services, scope of services, appeals processes, referrals for provision of services, and requirements of home and community-based services providers.

The proposed rules to be repealed and adopted may be reviewed prior to public hearing by:
Accessing the Department of Health’s website: http://gen.doh.hawaii.gov/sites/har/admrulechange/default.aspx; or
Requesting a copy to be sent through the mail (at requestors expense) by writing a letter of request to the Developmental Disabilities Division, 1250 Punchbowl Street, Room 463, Honolulu, Hawaii 96813; or
Viewing a hard copy at the Developmental Disabilities Offices, in person, on Oahu at 1250 Punchbowl Street, Room 463; on Hilo at 46 Keawe Street, on Kauai at 3040 Umi Street; on Maui at 210 Imi Kala Street, Suite 105; and on Molokai at 65 Makaena Street. A hard copy will be available for review in office only at the above respective offices.
All interested persons may submit testimony orally or in writing to the presiding hearings officer at the public hearing. Written testimony or proposed amendments will also be accepted until 4:30 p.m. on January 24, 2014, at Developmental Disabilities Division, 1250 Punchbowl Street, Room 463, Honolulu, Hawaii, 96813.
