PUBLIC NOTICE
The Department of Health, State of Hawaii, is notifying all interested persons of the proposed settlement between the Department of Health and American Hauling, LLC. The Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 12-CA-EO-08, alleging that American Hauling, LLC violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2 and Covered Source Permit (“CSP”) No. 0694-01-CT by failing to meet various Monitoring, Reporting and Annual Fee requirements. Subsequent to the issuance of the NFVO under Docket No. 12-CA-EO-08, pursuant to an October 9, 2012 records review of Respondent’s CSP 0694-01-CT, the DOH alleges that on August 31, 2012, American Hauling, LLC had violated Attachment II, Section E, Special Condition 5 by not submitting the January to June 2012 semi-annual monitoring report.
A Consent Order has been drafted that proposes to settle this case. Interested persons may submit written comments on this proposed settlement to the Department of Health within 30 days of this notice.
