PUBLIC NOTICE

`The Department of Health, State of Hawaii, is notifying all interested persons of the proposed settlement between the Department of Health and Hawaii Electric Light Company, Inc. (HELCO). The Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 12-CA-EO-04, alleging that HELCO violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2 and Covered Source Permit (“CSP”) No. 0007-01-C by:
1. Exceeding Combustion Turbine Generator Unit CT-4’s 3-hour average ammonia emission limit on March 9, 2011, March 10, 2011, March 11, 2011, March 12, 2011 and March 14, 2011.
2. Exceeding Combustion Turbine Generator Unit CT-4’s visible emissions requirements on April 15, 2011.
3. Exceeding Combustion Turbine Generator Unit CT-5’s visible emissions requirements on November 11, 2011.

Subsequent to the violations noted in the NFVO found under Docket No. 12-CA-EO-04, pursuant to three (3) deviation letters sent by Respondent to the DOH, the DOH alleges that on February 23, 2012, May 8, 2012 and June 1, 2012, Respondent’s Keahole Generating Station had violated the visible emissions limit of twenty (20) or sixty (60) percent opacity.
A Consent Order has been drafted that proposes to settle this case. Interested persons may submit written comments on this proposed settlement to the Department of Health within 30 days of this notice. Comments should be sent to Mr. Nolan Hirai, Manager, Clean Air Branch, Department of Health, P.O. Box 3378, Honolulu, Hawaii, 96801-3378. The proposed Consent Order and the Notice and Finding of Violation and Order may be reviewed at the Clean Air Branch in Honolulu, 919 Ala Moana Boulevard, Suite 203 and at the Clean Air Branch in Kona, District Health Office, 79-1015 Haukapila Street, Kealakekua, Hawaii 96750.
