NOTICE OF HEARING
TO: BOBBY W. WOOD
TO: NEW HORIZONS FINANCIAL, INC.
TO: ACCEL MORTGAGE, LLC
EACH OF YOU ARE NOTIFIED that the Director of the Department of Commerce and Consumer Affairs, on behalf of the former Mortgage Brokers and Solicitors Program under Chapter 454 (repealed) of the Hawaii Revised Statutes (hereafter “HRS”), will conduct a hearing in cases MBS 2009-50-L (Bobby W. Wood), MBS 2012-11-L (New Horizons Financial, Inc.), and MBS 2012-12-L (Accel Mortgage, LLC). The three cases have been consolidated into a single proceeding and the hearing will occur in accordance with HRS Chapters 91, 92, 436B and 454 (repealed), to determine whether BOBBY W. WOOD’s mortgage solicitor’s license, NEW HORIZONS FINANCIAL, INC.’s mortgage broker’s license, and, ACCEL MORTGAGE, LLC’s mortgage broker’s license should be revoked, suspended, or otherwise disciplined, and, whether monetary fines, restitution and any other relief authorized by law, should be imposed. The Petition For Disciplinary Action Against Mortgage Solicitor License; Demand For Disclosure To Respondent for case MBS 2009-50-L (Bobby W. Wood) was filed with the Office of Administrative Hearings (hereafter “OAH”) on or about 9/20/12. The Petition For Disciplinary Action Against Mortgage Broker License; Demand For Disclosure To Respondent for case MBS 2012-11-L (New Horizons Financial, Inc.) and case MBS 2012-12-L (Accel Mortgage, LLC) were filed with the OAH on or about 11/1/12. The three Petitions allege violations, by each of you, of the provisions of HRS Chapters 436B and/or 454 (repealed).
The HEARING will be conducted on January 17, 2013, at 9:00 a.m. The HEARING will take place in a hearings room at the Department of Commerce and Consumer Affairs, 335 Merchant Street, Suite 100, Honolulu, Hawaii.
