NOTICE OF PUBLIC HEARING
The Hawaii Housing Finance and Development Corporation (HHFDC), Department of Business, Economic Development and Tourism, State of Hawaii, will hold a public hearing on November 30, 2012, at 10:00 a.m. at the HHFDC Boardroom, 677 Queen Street, Suite 300, Honolulu, Hawaii 96813, on amendments to the ground lease for Halekauwila Place.
Halekauwila Place is a proposed 204-unit affordable family rental housing project to be constructed on a 1.25-acre site at 665 Halekauwila Street in Kakaako, Oahu, TMK: (1) 2-1-051:042 and 043. The project site is owned by the State of Hawaii and leased by the HHFDC to the project developer, Halekauwila Place LP, pursuant to a Ground Lease for a term of 75 years.
The purpose of the hearing is to receive testimony on amendments to Section 1 of the Ground Lease relating to Minerals and Waters that were requested by one of the project lenders. The amendments would waive the State’s right to use or occupy the surface of the property to mine and remove such minerals. The amendments would protect the affordable housing project from any mining operations on the property during the Ground Lease term. The water rights provisions in the ground lease are not proposed for amendment and will remain intact.
The proposed amendments are subject to approval by the State Board of Land and Natural Resources (BLNR) pursuant to Sections 182-2 and 182-4, Hawaii Revised Statutes. Comments and testimony received at the public hearing will be submitted by HHFDC to the BLNR for consideration prior to decision making on the amendment request.
Copies of the proposed amendments are available for public viewing on HHFDC’s website at http://hawaii.gov/dbedt/hhfdc. Copies may also be picked up at the HHFDC office at the address noted above. To receive a copy by mail, interested persons may call Mei Hui at 587-0529.
Interested persons are invited to attend the hearing and state their views, orally or in writing, related to the proposed Ground Lease amendments. Five copies of written testimony shall be given to the presiding officer at the hearing, or within seven days before the hearing to HHFDC, Attention: Stan Fujimoto, 677 Queen Street, Suite 300, Honolulu, Hawaii 96813.
