REQUEST FOR RELEASE OF FUNDS
On or about August 26, 2009 the City & County of Honolulu will submit a request to the United States Department of Housing and Urban Development (HUD) for the release of $2,000,000 of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, and $196,000 of Economic Development Initiative Special Projects Grant (EDI/SPG) funds under the HUD Appropriations Act of 2006 (PL 109-115), for the following project:
Project: Ohana Career and Learning Center

Activity Description: Goodwill Industries of Hawaii, Inc. proposes to construct and operate the Ohana Career and Learning Center. CDBG funds will be used for interior improvements and landscaping to the existing facility to include, but not limited to, items such as the flooring, doorways, fire system, cabinetry, painting, elevator, finishing work, restrooms, awnings, window shades, and walkway canopy. The 30,000 square foot two story facility will include a workforce development and employment center, retail center, and donation precessing center. After the completion of the project, an additional 1,600 individuals shall receive career development and training services.

PUBLIC COMMENTS
Any individual, group or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Ms. Deborah Kim Morikawa, Director, Department of Community Services, 715 South King Street, Suite 311, Honolulu, Hawaii 96813. All comments received by August 25, 2009 will be considered by the City & County of Honolulu prior to authorizing the submission of a Request for Release of Funds.
RELEASE OF FUNDS
The City & County of Honolulu certifies to HUD that Mr. Rix Maurer III in his capacity as Director of the Department of Budget and Fiscal Services, of the City & County of Honolulu consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City & County of Honolulu to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will consider objections to its release of funds and the City & County of Honolulu’s certification received by September 10, 2009 or a period of fifteen (15) days from its receipt of the request (whichever is later) only if it is on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City & County of Honolulu; (b) the City & County of Honolulu has omitted a step or failed to make a decision or finding required by HUD regulations at 24 Code of Federal Regulations (CFR), Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a Release of Funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to Hawaii State Office, United States Department of Housing and Urban Development, 500 Ala Moana Boulevard, Suite 3A, Honolulu, Hawaii 96813. Potential objectors should contact HUD to verify the actual last day of the objection period.
