Notice of Proposed Rulemaking
Public Hearing

Pursuant to Chapter 91, Hawaii Revised Statutes, notice is hereby given that the Department of Labor and Industrial Relations, State Fire Council (“SFC”) will hold a public hearing on Thursday, October 1, 2009, at 1:00 p.m. in the auditorium at the Honolulu Fire Department Headquarters, 636 South Street, Honolulu, Hawaii 96813, to hear all persons interested in the proposed rules pertaining to the State Fire Code.

The purposes of the proposed rules are to repeal the current State Fire Code, chapter 12-45.1, Hawaii Administrative Rules (“HAR”) which adopted and amended the 1997 UNIFORM FIRE CODE, published by the International Fire Code Institute and the 1999 ACCUMULATIVE SUPPLEMENT TO THE UNIFORM FIRE CODE published by the International Fire Code Institute and to adopt a new State Fire Code in chapter 12-45.2, HAR, which will update the State Fire Code by adopting in part and amending in part the NFPA 1, UNIFORM FIRE CODE, 2006 Edition (2005).

A copy of the proposed rules and the NFPA 1, UNIFORM FIRE CODE, 2006 Edition (2005) will be made available for public viewing from the first working day that the legal notice appears in the Honolulu Star Bulletin, Hawaii Tribune Herald, West Hawaii Today, The Maui News, and The Garden Island, through the day the public hearing is held, from Monday – Friday between the hours of 8:00 a.m. – 4:00 p.m. at the following locations:

A copy of the proposed rules can also be mailed at no cost to any interested party, upon written request to the State Fire Council at 636 South Street, Honolulu, Hawaii 96813. The NFPA 1, UNIFORM FIRE CODE, 2006 Edition (2005) can be purchased from the Municipal Reference Center, City Hall Annex, telephone number 808-768-3759 and address 558 South King Street, Honolulu, Hawaii 96813, open Monday – Friday, 7:45 a.m. – 4:30 p.m.

Interested person may present written or oral testimony at the time of the public hearing. All persons wishing to submit written testimony are requested to submit 5 copies of their written testimony before the public hearing to the State Fire Council, 636 South Street, Honolulu, HI 96813 or 5 copies may be submitted to the presiding officer at the public hearing. The public hearing will be continued, if necessary, to a time, date, and place announced at the scheduled hearing.

Interested persons unable to attend the public hearing, shall submit five copies of their written testimony concerning the proposals to the State Fire Council, 636 South Street, Honolulu, HI 96813. All submissions must be received at or prior to the scheduled public hearing.
