NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

On or about August 24, 2009, the State of Hawaii will authorize the Hawaii Public Housing Authority (HPHA) to submit a request to the U. S. Department of Housing and Urban Development (HUD) for the release of Captial Fund Program (CFP) funds under Title I of the United States Housing Act of 1937, as amended, to undertake any of the following HI08S00150109 (ARRA) projects:

Est. Funding: Varies ($500,000.00 to $10,000,000.00)
Funds for HI08S00150109 (ARRA) are available in the amount of $16,245,443.00.
The activities proposed are categorically excluded under the HUD regulations 24 CFR Part 58 from the National Environmental Policy Act requirements. Environmental Review Records (ERR) that document the environmental determinations for these projects are on file at the HPHA, 1002 North School Street, Bldg. C, Honolulu, Hawaii and may be examined or copied weekdays from 7:45 a.m. to 4:30 p.m.
PUBLIC COMMENT
Any individual, group, or agency may submit written comments on the ERR to the HPHA. All comments received by August 24, 2009 will be considered by the State of Hawaii prior to submission of a request for release of funds.
RELEASE OF FUNDS
The State of Hawaii certifies to the HUD that the Honorable Linda Lingle, in her capacity as Governor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The HUD’s acceptance of the certification satisfies its responsibilities under NEPA and allows the HPHA to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
Mr. Michael S. Flores, Director, Office of Public Housing, Honolulu Field Office at (808) 522-8175, ext. 226, will accept objections to its release of funds and the State of Hawaii’s certification for a period of fifteen calendar days following the anticipated submission date or its actual receipt of the request (whichever is later) only if it is on one of the following basis: (a) the certification was not executed by the Certifying Officer of the State of Hawaii; (b) the State of Hawaii has omitted a step or failed to make a decision or finding required by the HUD regulations at 24 CFR Part 58; (c) the grant recipient has incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the HUD at 500 Ala Moana Boulevard, Suite 3A, Honolulu, Hawaii 96813-4918. Potential objectors should contact the HUD to verify the actual last day of the objection period.
