NOTICE OF HEARING

TO: AUTO BUYERS & SALES, LLC

AND TO: JOSEPH E. SCANLON, JR.

YOU ARE NOTIFIED that the Motor Vehicle Industry Licensing Board will conduct a hearing, in cases MVI 2008-51-L and MVI 2009-47-L, in accordance with Hawaii Revised Statutes (hereafter “HRS”) Chapters 91, 92, 436B and 437 to determine whether AUTO BUYERS & SALES, LLC’s motor vehicle dealer’s license, and whether JOSEPH E. SCANLON, JR.’s car salesman license should be revoked, suspended, or otherwise disciplined, and, whether monetary fines, restitution and any other relief authorized by law, should be imposed. The Petitions For Disciplinary Action in each of these cases (MVI 2008-51-L and MVI 2009-47-L) were filed with the Office of Administrative Hearings on or about March 24, 2009 and May 12, 2009 respectively, and, they allege violations of the provisions of HRS Chapters 436B and 437.

A pre-hearing conference will be held on July 13, 2009 at 10:30 a.m. The HEARING will be conducted on August 19, 2009 at 9:00 a.m. The pre-hearing conference and HEARING will take place in a hearings room at the Department of Commerce and Consumer Affairs, 335 Merchant Street, Suite 100, Honolulu, Hawaii.
