NOTICE OF PUBLIC HEARING

Pursuant to Sections 91-3 and 92-41, Hawaii Revised Statutes, notice is hereby given that the Aloha Tower Development Corporation (ATDC), Department of Business, Economic Development and Tourism (DBEDT), State of Hawaii, will hold a public hearing on July 27, 2009 at 10:00 a.m. to consider the proposed amendments to Chapter 15-26, “Aloha Tower Development Corporation – Rules of Practice and Procedure,” Hawaii Administrative Rules (HAR).

On February 9, 1989, the Office of the Lieutenant Governor approved and made effective ATDC’s Rules of Practice and Procedure, HAR §§15-26-1 to 15-26-50 (Subchapters 1 to 5). The ATDC Rules of Practice and Procedure have not been updated to reflect legislative changes to Chapter 206J, Hawaii Revised Statutes (HRS), and other statutes cited in the HARs. Therefore, ATDC believes it is the appropriate time to update Subchapters 1 to 5 of its HARs.

The following are examples of some of the substantive changes being proposed to reflect the legislative changes to Chapter 206J, HRS:

1) Election of the Board Chairperson by a majority vote of the Boardmembers;
2) Inclusion of the Harbors Modernization Group and describing its makeup, purpose and the Harbors Modernization Plan;
3) Inclusion of references to ATDC’s Bylaws and other existing HRS sections defining standardized practices and procedures that were different in ATDC’s existing rules of practice and procedures; and
4) Standardization of ATDC’s procedures for “Proceedings Before the Board” and “Rule Relief.”

A public hearing will be held on July 27, 2009 at 10:00 a.m. at the ATDC Offices located at:

All interested persons are invited to attend the hearing and state their views relative to the proposed amended rules either orally or in writing. Should written testimony be presented, five copies shall be made available to the presiding officer at the public hearing or within seven days before the hearing to:

Copies of the proposed amended rules are available for review at the ATDC Offices located at the above-listed address during regular business days and hours between 7:45 a.m. and 4:30 p.m. Copies are also available on the ATDC web site at http://www.alohatower.org. Copies of the proposed amended rules may also be mailed to any interested person upon advance payment of $3.59 to ATDC for copying and postage costs.
