NOTICE OF PUBLIC HEARING
EMPLOYEES’ RETIREMENT SYSTEM
PROPOSED RULE MAKING

Pursuant to Chapter 91, Hawaii Revised Statutes, notice is hereby given that the Employees’ Retirement System of the State of Hawaii (“ERS”) will hold a public hearing to consider proposed amendments and other changes to Title 6, Hawaii Administrative Rules (“HAR”) for the following chapters:
1. HAR Chapter 6-20: amendment of definitions applicable to HAR Chapters 6-20 through 6-29; amendment of rule regarding disclosure of information in ERS records regarding deceased persons; amendment of rule regarding how much ERS may charge for copies of government records; amendment of rules regarding requirements and procedures for ERS declaratory ruling proceedings.
2. HAR Chapter 6-22: amendment of rules regarding requirements and procedures for certifications and findings of the ERS Medical Board.
3. HAR Chapter 6-23: amendment of rules regarding requirements and procedures for contested cases hearings on applications for disability retirement and accidental death benefits; amendment of rules regarding requirements and procedures for other types of ERS contested case hearings.
4. HAR Chapter 6-24: amendment of rules regarding requirements and procedures for election of members and retirants to the ERS board of trustees.
5. HAR Chapter 6-26: amendment of rules regarding requirements and procedures for applications for retirement; amendment of rules regarding proof and computation of an ERS member’s age.

The public hearing will be held at the following time and place:
July 13, 2009, at 9:00 a.m.
City Financial Tower

Honolulu, Hawaii

All interested persons are invited to attend the hearing and to state their views relative to the proposed rule amendments, either orally or in writing. Residents of the neighbor islands who are unable to attend the public hearing and wish to give oral testimony should call (808) 586-1735 or the toll free number from the neighbor islands (see below) no later than July 6, 2009 to make arrangements for their testimony to be given over the phone. For written testimony only, five (5) copies of the testimony must be provided to the presiding officer at the public hearing or mailed or delivered before July 13, 2009 to the following address:

A copy of the proposed rule amendments will be mailed to any interested person who requests a copy and prepays $10.00 for copying and postage (make check payable to Employees’ Retirement System). Interested persons may request a copy of the proposed rule amendments by calling (808) 586-1735 or the toll free number from the neighbor islands (see below) or by writing to:

A copy of the proposed rule amendments may be reviewed in person from Monday through Friday, from the date of this notice to July 13, 2009, between the hours of 7:45 a.m. and 4:30 p.m. (except holidays) at all ERS branch offices including the neighbor islands.

The proposed rule amendments will also be available on the internet at the following website:
