NOTICE OF PUBLIC HEARINGS
BOARD OF REGENTS
UNIVERSITY OF HAWAI’I

Pursuant to provisions of Chapter 91, Hawai’i Revised Statutes, notice is hereby given that the Board of Regents of the University of Hawai’i will hold a public hearing on proposed Administrative Rules governing schedule of penalties for disabled parking violations and regular parking rates at the University of Hawai’i at Manoa campus. The public hearing will be held as follows:

The University is proposing two amendments to Hawai’i Administrative Rules, Chapter 20-12, Subchapter 1. The first proposed amendment would revise Section 20-12-9, HAR, “Violations and Schedule of Penalties for UH-Manoa” dated July 16, 1999, by increasing the University of Hawai’i at Manoa minimum parking fine assessment for disabled parking violations to the equivalent of the State of Hawai’i’s minimum statutory assessment as follows: (1) Increase current fine from $150 to $250 for violations involving parking in a space reserved for persons with disabilities, and: a) failing to properly display a valid windshield placard or special license plate; b) displaying an invalid windshield placard or special license plate; or c) using a windshield placard or special license plate that was not issued to the driver or any passenger occupying the vehicle; (2) Assess a $25 fine for violations involving parking in a space reserved for persons with disabilities by a person issued a valid windshield placard or special license plate, but failing to properly display the windshield placard or special license plate; (3) Assess a $250 fine for violations involving with or without a windshield placard or special license plate: a) parking in an access aisle adjacent to a parking space reserved for a person with a disability; or b) obstructing the ingress or egress to a parking space reserved for a person with a disability; (4) Assess a $250 fine for violations involving parking in a space reserved for persons with disabilities and refusing or failing to present an identification card to an enforcement officer upon request.

The second proposed amendment would revise Section 20-12-8, HAR, “Regular Parking Fees for UH-Manoa” dated July 16, 1999, by increasing parking permit rates at UH Manoa each year over a five-year period. Parking permit rates for upper campus would increase by 25% the first year and 10% each of the next four years, and parking permit rates for lower campus would increase by 15% the first year and 10% each of the next four years. The annual permit rates would be divided equally among the three semesters (fall, spring, and summer). The parking rates increases are required to meet future budget requirements and to maintain UH Manoa Parking Operations’ self-sustaining status. The increased rates will provide funds to cover increased operating and capital costs, including costs of repair projects for health and safety and maintenance concerns; inflationary increases in operating expenditures for personnel costs and service contracts; and increased debt service for the Phase I lower campus parking structure pursuant to a restructured payment schedule.

The preceding summary of the proposed amendments is provided for your convenience. Complete copies of the proposed amendments may be picked up at the Office of the Board of Regents, 2444 Dole Street, Room 209, Honolulu, Hawai’i 96822 between 8:00 a.m. and 4:30 p.m., Monday through Friday, excluding holidays. Copies will be mailed upon request to any interested person.

Individuals wishing or unable to appear at the specified hearing are urged to file signed statements providing their views on the subject. Such statements will be received up to and including the date and time of the public hearings and should be addressed to:
