PROCLAMATION

Pursuant to Section 11-91, Hawaii Revised Statutes (HRS) and Section 3-105, Revised Charter of the City and Honolulu, I, BERNICE K.N. MAU, Acting City Clerk, City and County of Honolulu, do hereby proclaim that a Special Election will be held on April 23, 2009 for the purpose of electing a councilmember to fill a vacancy in Council District III in the City and County of Honolulu.

The term of office for the council member elected to fill the vacancy shall be for the remainder of the un-expired term of the office.

Pursuant to HRS §11-91.5, the special election shall be conducted exclusively by mail. No polling places will be open on Election Day, Thursday, April 23, 2009.

Pursuant to HRS §11-24, properly registered voters of Council District III as of the closing of the general county registry thirty (30) days prior to the election will be sent a vote-by-mail ballot. Any person registered in the District whose address had been previously determined as changed due to previously undeliverable election mail will not be sent a vote-by-mail ballot. Vote-by-mail ballots will be mailed no later than twenty days (20) prior to Election Day.

Pursuant to HRS §11-21, any voter transferring voter registration into Council District III less than thirty days prior to the election and after the close of the general county registry for the special vacancy election, will be allowed to vote in the Special Election. That registered voter shall be responsible for applying for an absentee mail ballot or voting at the absentee polling place.

Pursuant to the period of time established in HRS 12-2.5, nomination papers shall be available until 4:30 p.m. on March 9, 2009 when the nomination filing period closes.

To the greatest extent practicable, the vote-by-mail Special Election will utilize applicable laws, procedures, and processes that govern absentee mail voting in regular elections.

Notice is hereby given that all voted mail ballots must be received by 6:00 p.m. on Election Day in order to be counted. In lieu of mailing, voters may also elect to drop off their voted mail ballot envelope at the Office of the City Clerk, City Hall, 530 S. King St, 100, Honolulu, Hawaii 96813 between the hours of 7:45 a.m. to 4:30 p.m. through Wednesday, April 22, 2009 and between the hours of 7:00 a.m. to 6:00 p.m. on Election Day, Thursday, April 23, 2009.

PUBLIC NOTICE OF ABSENTEE VOTING

Pursuant to Section 11-92.3, Hawaii Revised Statutes, I, BERNICE K.N. MAU, Acting City Clerk, City and County of Honolulu do hereby give public notice that an absentee polling place will be established for voters of Council District III at City Hall, 530 S. King Street, Honolulu, Hawaii 96813.

Voters that are unable to receive the vote-by-mail ballot at their address reflected in the general county registry shall be responsible for requesting an absentee mail ballot or voting at the absentee polling place.

Voters requiring the use of a disabled accessible electronic voting machine or voters wishing to cast a vote in person may vote at the absentee polling place between the hours of 8:00 a.m. to 4:00 p.m. from Monday, April 6, 2009 through Tuesday, April 21, 2009, excluding Sundays and holidays. The absentee polling place will be open on Saturdays during this time period. The absentee polling place will feature direct recording electronic voting machines exclusively.
