NOTICE OF PUBLIC HEARING

APPLICATION OF KAPALUA WATER COMPANY, LTD. FOR REVIEW AND APPROVAL OF RATE INCREASES, REVISED RATE SCHEDULES, AND REVISED RULES

DOCKET NO. 2008-0325

The STATE OF HAWAII (“State”) PUBLIC UTILITIES COMMISSION (“Commission”), pursuant to Hawaii Revised Statutes (“HRS”) §§ 269-12 and 269-16, HEREBY GIVES NOTICE that it will hold a public hearing on Wednesday, March 11, 2009, 6:00 p.m. at the Lahaina Civic Center, 1840 Honoapiilani Highway, Lahaina, Maui, relating to the Application of KAPALUA WATER COMPANY, LTD. (“KWC”), filed on January 15, 2009, for Commission approval of rate increases, revised rate schedules, and revised rules (“Application”).
KWC, a public utility which provides potable and non-potable water utility service on the island of Maui, proposes to: (1) increase its various monthly meter charges by approximately 111%; (2) increase its various monthly water consumption charges by up to approximately 57.2%; (3) increase its various private fire service charges by approximately 25 to 28.6%; (4) establish an Automatic Power Cost Adjustment Clause (“APCAC”) for its water service, which permits adjustments for electric costs during the year; (5) establish a Purchased Water Adjustment Clause (“PWAC”), for the electricity component of its purchased water costs; and (6) amend Rule VI, Section 15(a) of its Rules and Regulations to increase its reconnection fee from $5.00 to $50.00. KWC seeks a 2009 test year net revenue increase of $473,561; an approximate 26.9% increase over the pro forma revenue amount of $1,759,260 at present rates for the 2009 test year. However, the increases to be finally approved by the Commission, if any, may be higher or lower than KWC’s proposed rates/charges noted in its Application.

All interested persons are invited to attend the public hearing to state their views. Statements may also be mailed to the Public Utilities Commission, 465 South King Street, #103, Honolulu, Hawaii 96813, or at Hawaii.PUC@Hawaii.gov. All written statements should reference Docket No. 2008-0325. Motions to intervene or participate in this proceeding shall be filed with the Commission by March 23, 2009.
