PUBLIC NOTICE
The Department of Health, State of Hawaii, is notifying all interested persons of the proposed settlement between the Department of Health and Hamakua Macadamia Nut Company. On November 29, 2007, the Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 08-CA-EO-01, alleging that Hamakua Macadamia Nut Company violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2, and the Noncovered Source Permit (NSP) No. 0482-01-N, by operating its boiler with an exhaust emission of forty-seven (47) percent opacity, thus exceeding the visible emission limit of twenty (20) percent opacity, and by operating its boiler and venturi-wet scrubber without the pressure gauges on the venturi-wet scrubber, during its macadamia nut procession operations at it facility at 61-3251 Maluokalani Street, Kawaihae, Hawaii.
A Consent Order has been drafted that proposes to settle this case. Interested persons may submit written comments on this proposed settlement to the Department of Health within 30 days of this notice.
