NOTICE OF HEARING

NOTICE IS HEREBY GIVEN of the hearing to be held in the City and County of Honolulu by the Hawaii Community Development Authority (“HCDA”) of the State of Hawaii to consider an application for approval of the Ward Neighborhood Master Plan pursuant to Title 15, Chapter 22, Subchapter 8, Hawaii Administrative Rules, as amended:

Approval Requested: Master Plan Permit for a long-range development plan for an area within the Kakaako Community Development District which describes the overall character of development and the manner in which individual development projects will be implemented.

Copies of the Ward Neighborhood Master Plan Application and the Authority’s Rules governing the above Master Plan Application may be inspected at the offices of the HCDA, City and County of Honolulu, 677 Ala Moana Boulevard, Suite 1001, Honolulu, Hawaii 96813, during office hours from 7:45 a.m. to 4:30 p.m., Monday through Friday, except State holidays.
All persons who have some property interest in the land, who lawfully reside on the land, or who otherwise can demonstrate that they will be so directly and immediately affected by the proposed Ward Neighborhood Master Plan such that their interest in the proceeding is clearly distinguishable from that of the general public shall be admitted as parties upon timely application for intervention.
All other persons may apply to the Authority for leave to intervene as parties. Leave to intervene shall be freely granted, provided that the Authority or its hearings officer, if one is appointed, may deny an application to intervene when in the Authority’s or hearings officer’s sound discretion it appears that: (1) the position of the applicant for intervention concerning the proposed Ward Neighborhood Master Plan is substantially the same as the position of a party already admitted to the proceeding; and (2) the admission of additional parties will render the proceedings inefficient and unmanageable. A person whose application to intervene is denied may appeal such denial to the circuit court pursuant to Section 91-14, HRS.
The petition for intervention shall contain the petitioner’s name, contact information, and basis for intervention, and shall be filed with the HCDA at its offices by 4:30 p.m., on November 26, 2008.
A pre-hearing for potential intervenors will be held on December 1, 2008, at the HCDA offices at 10:00 a.m., at which time (i) the process will be explained and the calendar described, and (ii) the issues, timeframe for exchange of exhibits, and witness lists will be established.
A hearing on Petitions for Intervention will be held on December 17, 2008, at the HCDA offices at 9:00 a.m. At this hearing, the parties to the contested case hearing will be established. Immediately following this hearing, the contested case hearing will commence with the established parties.
Any party to the proceeding may be represented by legal counsel. An individual may appear on the individual’s own behalf, or a member of a partnership may represent the partnership, or an officer or authorized employee of a corporation, trust, or association may represent the corporation, trust, or association.
