NOTICE OF PUBLIC HEARING
MAUI PLANNING COMMISSION
The Maui Planning Commission for the County of Maui hereby gives notice that it will conduct a hearing on November 25, 2008 commencing at 8:30 a.m., or as soon thereafter as is practicable in the Planning Department Conference Room, 1st Floor, Kalana Pakui Building, 250 S. High Street, Wailuku, Maui, Hawaii 96793 on the following:
COMMUNITY PLAN AMENDMENT, CONDITIONAL PERMIT, SHORELINE SETBACK VARIANCE & SPECIAL MANAGEMENT AREA USE PERMIT
WESTERN APARTMENT SUPPLY & MAINTENANCE COMPANY requesting the following land use changes for the Maui Oceanfront Inn and Sarento’s on the Beach Restaurant project at 2980 South Kihei Road, TMK: 3-9-004: 029 and 3-9-004: 149, Kihei, Island of Maui (R. Loudermilk)
a. Community Plan Amendment from Single Family Residential to H-M Hotel (CPA 2006/0005);
b. Conditional Permit to maintain current parking use and provide improvements with the construction of a paved parking lot on Parcel 149. (CP 2006/0012)
c. Shoreline Setback Variance to maintain current hotel and restaurant uses of the subject property and improve parcel 149 with the construction of a paved parking lot. (SSV 2006/0004)

SPECIAL MANAGEMENT AREA USE PERMIT
1. A&B WAILEA LLC requesting a Special Management Area Use Permit and a Step 2 Planned Development Approval for the proposed MF-10 Multi-Family Use Project at Wailea Resort consisting of nine (9) improved single family residential lots, 36-multi-family units housed in four (4) buildings, commercial center of approximately 64,000 square feet, and related site improvements located northeast of Wailea Ike Drive and Wailea Ike Place, TMK: 2-1-008: 121, Wailea, Island of Maui. 2. MR. SANDY BAZ of MAUI ECONOMIC OPPORTUNITY, INC. requesting a Community Plan Amendment from Agricultural to Light Industrial Use and a Change in Zoning from Agricultural District to M-1 Light Industrial District for the MEO Transportation Center Project on approximately 10.041 acres of land at TMK: 3-8-006: portion of 004, Kahului, Island of Maui. The subject public hearings will be conducted in accordance with the Hawaii Revised Statutes, the Maui County Code and the Rules of the Maui Planning Commission. Information pertaining to the subject applications may be obtained from the Maui County Planning Department, 250 S. High Street, Wailuku, Maui.
Petitions to intervene shall be in conformity with Section 12-201-20 of the Rules of Practice and Procedure for the Maui Planning Commission and shall be filed with the Commission and served upon the applicant no less than ten (10) days before the first public hearing date. Filing of all documents to the Commission is c/o the Maui Planning Department, 250 South High Street, Wailuku, Maui, Hawaii 96793. The deadline for the filing of a timely petition to intervene is November 10, 2008.
All testimony regarding the subject applications may be filed prior to the date of the hearing by providing 15 copies of said written testimony to the Department of Planning or may be presented at the time of the hearing.
