NOTICE OF PUBLIC HEARING
LANAI PLANNING COMMISSION

The Lanai Planning Commission for the County of Maui hereby gives notice that the public hearing has been scheduled for November 19, 2008, commencing at 6:00 p.m., or as soon thereafter as is practicable in the Lanai High & Elementary School Cafeteria, 555 Fraser Avenue, Lanai City, Lanai, Hawaii 96763 on the following matter:

SPECIAL MANAGEMENT AREA USE PERMIT AND PHASE 2 PROJECT DISTRICT APPROVAL

CASTLE & COOKE RESORTS, LLC requesting a Phase II Project District Approval and a Special Management Area Use Permit to construct an adult pool measuring 29.6 feet by 51 feet, related improvements, and resurfacing existing family pool deck at the Manele Bay Hotel, TMK: 4-9-017: 001, Manele, Island of Lanai. The subject public hearing will be conducted in accordance with the Hawaii Revised Statutes, the Maui County Code and the Rules of the Lanai Planning Commission. Information pertaining to the subject application may be obtained from the Department of Planning, 250 South High Street, Wailuku, Maui.

All testimony regarding the subject application may be filed prior to the date of the hearing by providing 15 copies of said written testimony to the Department of Planning or may be presented at the time of the hearing.

Petitions to intervene shall be in conformity with Section 12-401-20 of the Rules of Practice and Procedure for the Lanai Planning Commission and shall be filed with the Commission and served upon the applicant no less than ten (10) days before the first public hearing date. Filing of all documents to the Commission is c/o the Maui Planning Department, 250 South High Street, Wailuku, Maui, Hawaii 96793. The deadline for the filing of a timely petition to intervene is November 3, 2008.
