NOTICE OF PUBLIC HEARING
Pursuant to Hawaii Revised Statutes (“HRS“) chapters 91 and 440G, notice is hereby given that the Cable Television Division (“CATV“) of the Department of Commerce and Consumer Affairs (“DCCA“), will hold public hearings to hear all persons interested in a proposed new subsection to Hawaii Administrative Rules (“HAR”) section 16-131, pertaining to the designation and selection of public, educational, and governmental (“PEG”) access organizations.

In general, the proposed amendments specify that the Director of DCCA shall comply with the applicable provisions of the Procurement Code in HRS chapter 103D when designating and selecting PEG access organizations, and specify the factors that the Director considers when designating and selecting PEG access organizations.
All interested persons shall be afforded the opportunity to submit data, views, or arguments, orally or in writing, on the proposed rule amendments at the time of the public hearing. Persons wishing to submit written testimony are requested to submit four (4) copies of their written testimony to the Cable Television Division, Department of Commerce and Consumer Affairs, 335 Merchant Street, Room 101, Honolulu, Hawaii 96813, or by fax to (808) 586-2625, or via email to cabletv@dcca.hawaii.gov by October 13, 2008. Persons presenting oral testimony are also requested to submit four (4) copies of their testimony in writing to CATV at the address and by the time specified above.
A copy of the proposed rule amendments will be mailed to any interested person who requests a copy. Please submit your request to CATV at the address noted above or contact CATV at (808) 586 2620.
Copies of the proposed rule amendments may be picked up from CATV at the above address between the hours of 7:45 a.m. and 4:30 p.m., Monday through Friday, excluding State and federal holidays.
The proposed rule amendments may be reviewed in person free of charge at CATV at the address and hours of operation above. In addition, the full text of the proposed rule amendment is available and can be downloaded free of charge from DCCA’s web site: http://www.hawaii.gov/dcca.
