The State Department of Health (DOH), tentatively proposes to issue a National Pollutant Discharge Elimination System (NPDES) permit to discharge storm water runoff associated with construction activities, to receiving State waters, subject to special conditions to:

The proposed draft permit will expire five (5) years from the date of issuance.
The project is located at the Diamond Head State Monument in the vicinity of the intersection of Diamond Head Road and 18th Avenue, Honolulu, Hawaii, TMK: (2) 3-1-42:006. The State of Hawaii, Department of Land and Natural Resources is proposing to make improvements to the Diamond Head trail in two separate phases. Phase I of the project involves rock scaling to remove loose rocks and rubble from slope shelves above and along the interior Summit Trail and exterior face of the Kahala Tunnel. Phase 2 involves the following: slope and path stabilization at spot locations along the Summit Trail; pedestrian tunnel rockfall prevention measures; and the construction of a walkway in the proximity of the Leahi Fire Control Station.
Storm water runoff from the project will be subject to Best Management Practices prior to being discharged to the receiving State water, an unnamed inland wetland, a Class 1, Inland Water at the following discharge point coordinates: Latitude 21?15’42″N and
Longitude 157?48’13″W.
The receiving water is classified by the DOH as a Class 1, Inland Water. Objective of Class 1 waters is for these waters to remain in their natural state as nearly as possible with an absolute minimum of pollution from any human-caused source. To the extent possible, the wilderness character of these areas shall be protected.
Persons wishing to comment upon or object to the proposed NPDES permit or to request a public hearing, should submit their comments or requests in writing no later than 30 days after the date of this notice, either in person or by mail, to:

Copies of the proposed draft permit, and other information are available for public inspection, Monday through Friday (excluding holidays) from 7:45 a.m. until 4:15 p.m., at the DOH office address shown above. Copies may be bought. The draft permit and rationale are also available on the internet at

All written comments and requests received on time will be considered. If DOH determines that there is significant public interest, a public hearing may be held after at least
30 calendar days of public notice.
If DOH’s position is substantially unchanged after considering all timely written comments and all oral comments at any public hearing that may be held, then the DOH will issue the NPDES permit and this action will be final.
