NOTICE IS HEREBY GIVEN, of a public hearing to be held by the County of Kauai Planning Commission at the Lihue Civic Center, Mo`ikeha Building, Meeting Room 2A-2B, 4444 Rice Street, Lihue, Kauai on Tuesday, May 13, 2008, at 1:30 p.m., or soon thereafter to consider under the provisions of Special Management Area Rules and Regulations of the County of Kauai, as amended, the following:
1. Amendments to Special Management Area Use Permit SMA(U)-2005-8, Project Development Use Permit P.D.U-2005-26, Use Permit U-2005-25 and Class IV Zoning Permit Z-IV-2005-30 to allow implementation of a revised site master development plan to initiate vehicular access, resort residential units and affordable housing units, implementation of single-family residential lot subdivisions; redevelopment of a portion of the Fashion Landing commercial area into a commercial facility with restaurant and new golf clubhouse; relocation and reconfiguration of the Kiele Golf Course fairways and greens, off-street parking, temporary sales facilities, operations and administrative offices, electrical/mechanical facilities, underground sewage lift station with accessory equipment, final site layout development plans for two (2) public recreation/picnic shelters, showers and restroom facilities, and an unimproved public lateral shoreline access, on property situated in Nawiliwili-Lihue within the Kauai Lagoons Master Development Plan area immediately east of the existing Kauai Marriott resort facilities, identified as Tax Map Keys 3-5-01:27, 168, 169, 170, 171, 172, and 173 and on property situated immediately north of the intersection of Haoa Street and Kapule Highway, identified as Tax Map Key 3-5-01: 165.
All interested persons may present testimony for or against any application as public witnesses. Such testimony should be made in writing and presented to the Commission prior to the public hearing. Late written testimony may be submitted up to seven (7) days after the close of the public hearing in cases where the Commission does not take action on the same day the hearing was held.
Any party may be represented by counsel if he or she so desires. In addition, individuals may appear on their own behalf, a member of a partnership may represent the partnership, and an officer or authorized employee of a corporation or trust or association may represent the corporation, trust or association. Petitions for intervenor status must be submitted to the Commission and the applicant at least seven (7) days prior to the date of the hearing advertised herein and shall be in conformance with Chapter 4 of the Rules of Practice and Procedure of the Planning Commission
Proposed plans and the Rules of Practice and Procedure of the Planning Commission are available for inspection at the Planning Department which is located at 4444 Rice Street, Lihue, Kauai.
