Notice of Drawing for 19 Residential Leases for 19 Lots at Kikala-Keokea Residential Subdivision, Kikala and Keokea, Puna, Hawaii

Act 73, Session Laws of Hawaii of 2007 authorized the State of Hawaii, Department of Land and Natural Resources, subject to specific criteria and priority requirements, to award nineteen (19) residential leases for nineteen (19) lots at Kikala-Keokea Residential Subdivision. The Department of Land and Natural Resources may negotiate and enter into long-term residential leases, subject to renewal by mutual agreement, with persons who have attained the age of 18 years, and meet the following criteria:
1. Residents of Kalapana who have been living in Kalapana continuously for not less than six months at the time of their application;
2. Previous residents of Kalapana who resided within Kalapana continuously for not less than six months; or
3. Descendants of those residents of Kalapana who were dispossessed or displaced as a result of the volcanic eruptions on the island of Hawaii that began on January 3, 1983.
Furthermore, in awarding a lease to a person meeting the eligibility requirements of section 2 of Act 73, the Department of Land and Natural Resources shall give priority to the following:
1. Persons who were previously awarded a lease under Act 314, Session Laws of Hawaii 1991, but did not execute a lease;
2. Persons who were dispossessed or displaced as a result of the volcanic eruptions on the is land of Hawaii that began on January 3, 1983, who do not have any other residential property interest;
3. Persons who have no immediate family members who have executed a lease under this Act or under Act 314, Session Laws of Hawaii 1991;
4. Persons who have not executed a lease under this Act or under Act 314, Session Laws of Hawaii 1991;
5. Heirs of a person who was eligible for a lease under section 2 of Act 314, Session Laws of Hawaii 1991.
For the purpose of Act 73:
“Heirs” includes persons, including a surviving spouse or reciprocal beneficiary, who are entitled under the statutes of intestate succession to the property of a descendent.
“Immediate family members” includes grandparents, parents, siblings, spouse, reciprocal beneficiaries, children, and legal guardians.
The Department of Land and Natural Resources (DLNR), Land Division will be conducting a drawing for 19 residential leases for 19 Lots at Kikala-Keokea Residential Subdivision, at the following date and location:
DATE & TIME: Thursday, May 9, 2008 at 6:00 pm
PLACE: Pahoa Neighborhood Center, 15-2710 Kauhale Road, Pahoa, Hawaii 96778.
Persons who are interested and feel that they meet the eligibility criteria for a long-term residential lease for a lot within the Kikala-Keokea Residential Subdivision may obtain Application Forms from the Department of Land and Natural Resources, Land Division District Offices listed below:

Application Forms must be received by the Department of Land and Natural Resources no later than 4:00 pm on Monday, April 28, 2008 at any one of the District Land Offices. A person who has failed to submit an Application by this date and time will not be allowed to participate in the drawing. Applicants shall be informed in writing in advance of the drawing date as to his/her eligibility to participate at the drawing for a long-term residential lease for a lot within the Kikala-Keokea Residential subdivision.
A Bid Packet describing the drawing procedures, qualification requirements and other requirements, the draft lease document describing the terms and conditions of the lease, survey map, may be examined at the District Land Offices.

All persons who are interested and feel that they meet the eligibility criteria for a long-term residential lease for a lot within the Kikala-Keokea Residential Subdivision are responsible to thoroughly read and understand the covenants, terms, reservations and conditions contained in the Bid Packet, and draft lease document. Furthermore, all persons who are interested and feel that they meet the eligibility criteria for a long-term residential lease for a lot within the Kikala-Keokea Residential Subdivision are responsible to inspect the nineteen (19) lots.
All eligible persons, or authorized representatives must be present in person at the drawing. The Department of Land and Natural Resources reserves the right to cancel or postpone the drawing, to reject any and all Applications and to waive any defects when, in the opinion of the Chairperson of the Board of Land and Natural Resources, such action will be in the best interest of the State.
