Pursuant to Chapter 103D, HRS, SEALED TENDERS will be received up to and opened at 2:00 p.m., Hawaiian Standard Time (HST) on August 21, 2008, in the Office of the Department of Water, Lihue, Kauai, Hawaii. Bids received after the date and time specified above shall be rejected.

The Manager and Chief Engineer also reserves the right to reject any or all bids, in whole or in part, if deemed to be in the best interest of the County. Bids must be signed in ink by the person or persons duly authorized to sign bids in the space provided for signature on the bid form.

BIDDERS ARE HEREBY NOTIFIED THAT EVIDENCE OF THE AUTHORITY OF THE PERSON(S) SIGNING THE BID DOCUMENT IS REQUIRED TO BE INCLUDED WITH THE BID DOCUMENTS. FAILURE TO COMPLY WITH THIS REQUIREMENT WILL BE CAUSE FOR REJECTION OF THE BID AS BEING NON-RESPONSIVE.

COMBINATION OF TWO DEPARTMENT OF WATER PROJECTS: This project combines the two projects “SECTION A, JOB NO. 05-03, KW-25, KAPILIMAO 0.5 MG STORAGE TANK” and “ADDITIVE SECTION B, JOB NO. 03-03, KW-24, HARDENING OF GENERATOR SHELTER KAPILIMAO VALLEY WELL” as listed above. The Construction Plans and the Contract Specifications for each project shall be applicable only to itself and shall not be interpreted to be applicable to the other project.

SCOPE OF WORK:
SECTION A, JOB NO. 05-03, KW-25 – KAPILIMAO 0.5 MG STORAGE TANK – This section of the project consists of furnishing and paying for all labor, tools, equipment, and materials necessary for the construction of a 0.5 million gallon reinforced concrete storage tank facility, including but not limited to: clearing, grading, pavement, perimeter chain link fencing and security system, connecting pipe lines, drainage system, electrical and control systems, and all appurtenances in place complete, in accordance with the plans and specifications, ready for operation at the Kapilimao 0.5 MG storage tank site, Kekaha, Kauai, Hawaii.

SECTION B, JOB NO. 03-03, KW-24 – (ADDITIVE ITEM) -HARDENING OF GENERATOR SHELTER KAPILIMAO VALLEY WELL – This section of the project consists of furnishing and installing materials for the installation of hardened shelter structure, electrical conduits and hardware, and other equipment necessary to safety house emergency generators at the Department of Water’s well station at Kekaha. Also, furnishing and installing materials for the installation of asphalt concrete driveways, electrical facilities, chain link fences, and security gates.

PLANS AND SPECIFICATIONS: May be examined and obtained at the Department’s office at 4398 Pua Loke Street, Lihue, Kauai. Contract documents may be obtained upon deposit of One Hundred Dollars ($100.00) for each set in cash, certified check, or cashier’s check payable to the Department of Water along with a typed page with the Company’s name, street address, mailing address, telephone, and facsimile numbers.

CONTRACTOR’S LICENSE: All prospective Bidders must be currently licensed by the State of Hawaii, Department of Commerce and Consumer Affairs, Division of Professional and Vocational Licensing.

“A” general engineering contractors and “B” general building contractors are reminded that due to the Hawaii Supreme Court’s January 28, 2002 decision in Okada Trucking Co., Ltd. v. Board of Water Supply, et al, 97 Haw. 450 (2002), they are prohibited from undertaking any work, solely or as part of a larger project, which would require the general contractor to act as a specialty contractor in any area where the general contractor has no license. Although the “A” and “B” contractor may still bid on and act as the “prime” contractor on an “A” or “B” project (See, HRS § 444-7 for the definitions of an “A” or “B” project), respectively, the “A” and “B” contractor may only perform work in the areas in which they have the appropriate contractor’s license (An “A” or “B” contractor obtains “C” specialty contractor’s licenses either on its own or automatically under HAR § 16-77-32.). The remaining work must be performed by appropriately licensed entities. It is the sole responsibility of the contractor to review the requirements of this project and determine the appropriate licenses that are required to complete the project.

PRE-BID CONFERENCE: All potentially interested bidders, offerors, subcontractors, and union representatives are invited to attend the pre-bid conference on August 7, 2008, 8:30 a.m., at the Department of Water Office. A site visit will be scheduled following the pre-bid conference.
