The State of Hawaii, Department of Land and Natural Resources, is issuing an Invitation for Bids ("IFB") to qualified parties interested in a concession lease of state-owned lands, consisting of the improvements described as restaurant and retail concession space which area consists of approximately 1,200 square feet of building area and approximately 2,340 square feet of land area (see IFB Attachment "B"), within the Hapuna Beach State Recreation Area,  South Kohala, Hawai’i Island, Tax Map Key no. (3) 6-6-002:035 (por.), pursuant to Sections 171-14, -16, -17, -26 and -41,  and other applicable sections of Chapters 102 and 171, Hawaii Revised Statutes.
Before any prospective bidder shall be entitled to submit a bid, the prospective bidder must meet the minimum qualifications set forth in the IFB and shall submit a completed Qualification Questionnaire and give written notice of intent to bid on the Notice of Intention to Bid form by 4:00 p.m. on April 16, 2014, to the Division of State Parks of the Department of Land and Natural Resources, 1151 Punchbowl Street, Room 310, Honolulu, Hawaii 96813.
Prior to permitting any interested party to bid, the Department of Land and Natural Resources shall satisfy itself of the prospective bidder’s financial ability, experience, qualifications, and competence to carry out the terms and conditions of the concession contract that may be awarded.
SEALED BIDS are due on or before 4:00 p.m. on April 25, 2014, at the Division of State Parks of the Department of Land and Natural Resources, State of Hawaii, located at 1151 Punchbowl Street, Room 310, Honolulu, Hawaii 96813.

Sealed bids for IFB-09-HHL-007 for EAST KAPOLEI II OFFSITE TRUNK SEWER AND OFFSITE DRAINAGE SYSTEM, Honouliuli, Ewa, Oahu, Hawaii (TMK 9 1 17: por. 71 and 88), will be received by the Department of Hawaiian Home Lands (DHHL), Land Development Division, at Hale Kalanianaole, 91-5420 Kapolei Parkway, Kapolei, Hawaii, until 2:00 p. m., Hawaii Standard Time, December 23, 2008, at which time all bids will be publicly opened and read aloud.  Bids received after the time fixed for opening or delivered elsewhere other than specified herein, will not be considered.

The project consists of constructing the East Kapolei Offsite Trunk Sewer and East Kapolei II Offsite Drainage System as described below:

A. East Kapolei II Offsite Trunk Sewer
The work includes the furnishing of all labor, materials,  equipment and other incidentals necessary for the installation of approximately 3,200 lineal feet of 36-inch centrifugally cast glass-fiber reinforced sewer pipe and appurtenances, BMPs for erosion control, grading and grassing.  The work will include the installation of the pipe near a patch of endangered red ilima plants located in the Ewa Villages Golf Course.  The patch of red ilima plants shall not be disturbed and should any plant be disturbed, the Contractor shall be responsible for any penalties imposed by the Department of Land and Natural Resources.

B. East Kapolei II Offsite Drainage
The work includes the furnishing of all labor, materials,  equipment and other incidentals necessary for the construction of two detention basin systems, including erosion control BMPs, clearing and grubbing, grading,  grassing, outflow structure, manifold system and connection to the existing culverts under Mango Tree Road;  reconstruction of existing swales to drain to the new detention basins; and construction of an asphalt concrete base access and maintenance road.

To be eligible to submit a bid, the Bidder and/or its subcontractors must possess all required valid State of Hawaii licenses and specialty licenses needed to perform the work for this project.  A surety bid bond will be required for this IFB.

This project is subject to Section 103D, Hawaii Revised Statutes, to the requirements for Equal Employment Opportunity, and to the payment of not less than the prevailing salaries and wages promulgated by the State of Hawaii, Department of Labor and Industrial Relations.

NOTICE TO BIDDERS

SEALED TENDERS will be received up to and publicly opened at 2:00 p.m., on NOVEMBER 17, 2008, in the Office of the Division of Purchasing, Building C, Mezzanine Level, Department of Finance and Administration, Oahu Transit Services, Inc., 811 Middle Street, Honolulu, Hawaii, for the furnishing and delivery of FORD/NAVISTAR ENGINE FUEL INJECTORS, for the twelve-month period beginning December 1, 2008 and ending November 30, 2009.

Bidder’s are advised of the following:
 
DBE Assurances.  Discrimination on the basis of race, color, national origin or sex in the performance of this contract is prohibited.  The applicable requirements of 49 CFR Part 26 shall be carried out in the award and administration of this contract.  Failure to carry out these requirements is a breach of this contract, which may result in termination of this contract or such other remedy as the Vice President of Finance and Administration deems appropriate.

Civil Rights.  Nondiscrimination ( Title VI of the Civil Rights Act, as amended, Age Discrimination Act of 1975, as amended, Americans with Disabilities Act of 1990, as amended, and Federal transit law at 49 U.S.C. #5332) and Equal Employment Opportunity ( Title VII of the Civil Rights Act, as amended, 42 U.S.C. #2000e, and Federal transit laws 49 U.S.C. 5332, Age Discrimination in Employment Act of 1967, as amended, 29 U.S.C. #623) and Disabilities (American with Disabilities Act, as amended, 42 U.S.C. #12112) requirements shall apply to this project.

Program Fraud and False or Fraudulent Statements or Related Acts.  Program Fraud Civil Remedies Act of 1986, as amended, 31 U.S.C. 3801 et seq and U.S. DOT regulations, "Program Fraud Civil Remedies", 49 C.F.R.  Part 31, apply to this contract.

Bidders shall be registered and incorporated or organized under the laws of the State of Hawaii (hereinafter referred to as a "Hawaii business") or be registered to do business in the State of Hawaii, (hereinafter referred to as a "compliant non-Hawaii business).
