Bill 32:  Authorizes the Mayor of the County of Hawai’i to Enter Into an Intergovernmental Agreement for a State Water Pollution Control Revolving Fund Loan for Solid Waste Improvement Projects; and Authorizes the Issuance of $20,000,000 of General Obligation Bonds of the County of Hawai’i for the Purpose of Financing the South Hilo Sanitary Landfill Final Closure Project.  Funds would be used to satisfy closure requirements of the South Hilo Sanitary Landfill, to be repaid by the County over a 20-year term through the issuance of General Obligation Bonds.  Final design for the closure is anticipated to be complete by the end of 2017.  AYES:  Council Members Chung, David, Eoff, Kanuha, Lee Loy, O’Hara, Richards, Ruggles, and Chair Poindexter - 9; NOES:  None; ABSENT:  None; EXCUSED:  None.

A public meeting on the Draft Environmental Assessment will be held on Monday, May 1, 2017 at the West Hawai’i Civic Center’s Community Meeting Hale (Bldg. G), 74-5044 Ane Keohokalole Highway, from 5:00 PM to 6:30 PM to:

Allow individuals to comment, ask questions, and discuss concerns   regarding the Draft Environmental Assessment (DEA).

Discuss the County’s plans to replace the double-cell culvert bridging the   Waiaha Drainageway on Ali’i Drive; adjacent to the Kona Tiki Hotel.

Present the project’s description, history and scope of work, to construct a   new bridge structure that has a wider stream flow opening, a longer span   and wider lane bridge above.

KAU COMMUNITY DEVELOPMENT PLAN
On October 27, 2015, the Kau Community Development Plan (CDP) Steering Committee recommended approval of the Kau CDP.  After reviewing agency comment, the Planning Director is recommending non-substantive amendments to the CDP.  Pursuant to Section 2-28.1 of the Hawaii County Code, within sixty days after receipt of the Planning Director’s recommendation on a draft community development plan or any amendment thereof, the Windward Planning Commission shall transmit the draft community development plan or any amendment with its recommendation through the Mayor to the County Council.  Likewise, pursuant to Section 15.1 of the General Plan, the County Council may modify or amend the community development plan before enacting it by ordinance, but it shall give the Steering Committee and the Windward Planning Commission an opportunity to review and comment upon substantive amendments and modifications before final adoption of the plan. 
The purpose of this meeting and public hearing is to afford all interested persons a reasonable opportunity to comment on the Kau CDP and for the Commission to review the CDP and consider its recommendation to the County Council.
Submitting Testimony:  According to Rule 1 (General Rules) of the Planning Commission, a person desiring to submit oral or written testimony shall indicate her/his name; residence address; and whether the testimony is on her/his behalf or as a representative of an organization or individual.  If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony.  Written testimony shall be submitted with an original and nine copies prior to testifying.  The Commission would appreciate timely submittal to the Planning Department at least one week prior to the hearing date to allow for mailing and thorough Commission review.  Testimony that is irrelevant or unduly repetitious may be limited by the Chairperson pursuant to Rule 1.
Notice to Lobbyists:  If you are a lobbyist, you must register with the Hawaii County Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County Code}.  A lobbyist means "any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials."  {Article 15, Section 2-91.3(a)(6), Hawaii County Code}  Registration forms and expenditure report documents are available at the Office of the County Clerk, 25 Aupuni Street, Room 1402, Hilo, Hawaii 96720.

Proposal to Establish a Community-Based Subsistence Fishing Area
For the North Coast of Molokai

The Department of Land and Natural Resources (DLNR) will hold public scoping meetings to discuss a proposal to establish a Community-Based Subsistence Fishing Area (CBSFA) along the north coast of Molokai.  The proposed CBSFA extends from Ilio Point in the west to Kaholaiki Bay in the east, from the shoreline out to one nautical mile. The proposal, which was submitted to DLNR by Hui Malama O Moomomi, seeks to ensure the abundance and availability of marine resources to support traditional subsistence fishing practices.  DLNR is seeking public comments on proposed regulations, which would prohibit the commercial take of marine resources and establish new bag limits, size limits, gear restrictions, and seasonal protections for certain fish and invertebrate species within the CBSFA. 
Three meetings will be held at the following times and locations: March 16, 2017, Kulana Oiwi Halau, 600 Mauna Loa Highway, Kaunakakai, Molokai from 12:00 to 2:00 p.m.; Mitchell Pauole Center Conference Room, 90 Ainoa Street, Kaunakakai, Molokai from 5:30 to 8:30 p.m.; and March 21, 2017, Kawananakoa Middle School Cafeteria, 49 Funchal Street, Honolulu, Oahu from 6:00 to 9:00 p.m.
All interested persons are urged to attend one of the public meetings to learn more about the proposal and provide input.  Persons unable to attend or wishing to present additional comments, may mail written testimony by Tuesday, March 28, 2017 to the Division of Aquatic Resources (DAR), 1151 Punchbowl St., Room 330, Honolulu, HI 96813.
Anyone with a hearing impairment who desires to attend the public meeting may request assistance of a sign language interpreter.  The request may be made in writing (to the DAR address in the preceding paragraph), or by calling 587-0100 (voice or TDD) in Honolulu. The request will need to be received at least seven days before the hearing is scheduled to start. The PUBLIC UTILITIES COMMISSION of the STATE OF HAWAII ("Commission") HEREBY GIVES NOTICE that it will hold public meetings relating to the application of YOUNG BROTHERS, LIMITED ("Young Brothers"), filed on April 12, 2016, for approval of a general rate increase and certain tariff changes. 

The Commission will hold public meetings as follows:

The Commission will investigate whether the proposals in Young Brothers’ Application are just and reasonable.  Young Brothers is a water carrier authorized to transport property by barge between the islands of Oahu, Hawaii, Kauai, Maui, Molokai, and Lanai.  Young Brothers seeks the Commission’s approval for an across-the-board general rate increase of 4.36 percent, for an increase in revenues of $3,135,000.  Young Brothers states that the increase is based on an intrastate rate of return of 10.25 percent and an intrastate revenue requirement of $75,019,721.  Young Brothers also proposes certain other changes to its tariff.
The purpose of these public meetings are to listen to the views expressed by the general public on the Application of Young Brothers.  Therefore, the Parties to this proceeding—Young Brothers and the Consumer Advocate, a division of the State of Hawaii Department of Commerce and Consumer Affairs—will not be permitted to testify at the public meetings.  However, representatives from Young Brothers and the Consumer Advocate should be present at the public meetings to receive the testimony from the general public.
All interested persons, who are not Parties, are invited to attend the public meetings to state their views orally, in writing, or both.  Written statements may be submitted prior to or at the public meetings, and may be mailed to the Commission at 465 South King Street, Room 103, Honolulu, Hawaii, 96813, or sent by electronic mail to .(JavaScript must be enabled to view this email address).  All written statements should reference Docket No. 2016-0014, and include the author’s name and the entity or organization that the author represents.

The CP is a collaborative process whereby a community establishes a unified vision for community development actions. The City’s CP will be submitted to the U.S. Department of Housing and Urban Development (HUD) establishing the priority areas and types of projects that may be funded through the CDBG, HOME, ESG and HOPWA Programs in program years 2016-2020.
